Frank Deng is the typical goddamn lying chink claiming to be the "Father of Flash Memory". It was invented in 1984 by Fujio Masuoka at Toshiba.

I don't see any inconsistency here, and I agree with yu(888).

Basically, the convential wisdom seems to be playing out predictably, but I think the larger issue here and what makes it "Chinese," is that it is simply another instance in which China has not been a "responsible stakeholder," in the parlance of the US DOS. And I think that a basic disregard for the commons is something that extends deeply into the Chinese mentality, cutlure, and society.

"Oddly, it is only when foreign corporations begin to violate their own countries’ domestic IP laws, threatening Chinese IPR that the Chinese begin to respect those laws.

How very Chinese."

Actually, its not unusual for someone, or in this case, some country, to take these rights more seriouly when it becomes more relevant to them. In fact, it has always been known that China would enforce more agressively only after the negative inpact was becoming painful to her economic growth. So no news here.

It seems Netac holds these patents rightfully and has precidence in winning several other suits against others in the field for infringement. So with these sucesses, they are now targetting PNY, which is a NJ based flash memory company and a major competitor of Netac.

Future sucesses of such suits will actually be good for IPR enforcemnet in China and will be beneeficial to all IPR holders.

Does the US company have an office in China? How did the chinese company become aware of this supposed "IP violation"?

Not sure why FT ran this article now since the lawsuit has been around since at least February, when I wrote on it here, in a post entitled, "Man Bites Dog -- Chinese Company Sues in U.S. for Patent Protection." http://www.chinalawblog.com/chinalawblog/2006/02/man_bites_dog_c.html
